CyFun Compliance Assessment Tool — Asphalia Consulting SRL

1. About the tool

The CyFun Compliance Assessment Tool (the “Tool”) is a free online tool provided by Asphalia Consulting SRL (VAT: BE 0804.870.960) that helps organisations self-assess their compliance with the CyberFundamentals Framework (CyFun), the Belgian cybersecurity framework published by the Centre for Cybersecurity Belgium (CCB). The Tool is not affiliated with, endorsed by, or officially approved by the CCB. CyFun and its underlying framework content are the property of the CCB and the Belgian State.

2. No legal or compliance advice

This Tool is provided for informational and self-assessment purposes only. It does not constitute legal advice, regulatory guidance, certification, or a definitive compliance determination. The results generated by this Tool are indicative only and should not be relied upon as a substitute for professional legal or security counsel, or as evidence of compliance with any regulatory obligation. Asphalia Consulting SRL expressly recommends that users consult qualified legal and cybersecurity professionals before making compliance decisions or submitting formal assessments to any authority.

3. No warranty

The Tool is provided “as is” and “as available”, without any warranty of any kind, express or implied, including but not limited to warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement. The CyberFundamentals Framework content embedded in the Tool is sourced from publicly available CCB documentation and is reproduced in good faith, but Asphalia Consulting SRL makes no warranty that it is complete, current, or reflects the latest CCB publications, regulatory interpretations, or legislative amendments. Users are advised to verify requirements against official CCB sources at cyfun.eu.

4. Limitation of liability

To the fullest extent permitted by applicable Belgian law, including the Belgian Code of Economic Law (Wetboek van Economisch Recht / Code de droit économique), Asphalia Consulting SRL shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the use of, or inability to use, this Tool, including damages resulting from reliance on the assessment results, loss of data, or failure to obtain a compliance certification. This limitation applies regardless of the theory of liability.

5. You are the data controller of your assessment data

All assessment data you enter (organisation names, scores, notes, evidence) is stored exclusively in your own browser’s local storage. You are solely responsible for the content you enter and for compliance with any applicable data protection obligations relating to that content. Asphalia Consulting SRL does not process, access, or receive this data. If your assessment data includes personal data relating to individuals, you act as the data controller for that data under GDPR and are responsible for ensuring an appropriate legal basis for its processing.

6. Intellectual property

All design, source code, branding, and original content of the Tool are the property of Asphalia Consulting SRL and are protected by applicable intellectual property law. The CyberFundamentals Framework, its structure, requirement identifiers, and official documentation are the property of the Centre for Cybersecurity Belgium (CCB) and the Belgian State, made publicly available under the terms determined by the CCB. You may use this Tool freely for personal and professional purposes. You may not reproduce, redistribute, resell, or create derivative works of the Tool’s source code or design without prior written consent from Asphalia Consulting SRL.

7. Availability

We do not guarantee uninterrupted, error-free, or permanent availability of this Tool. We reserve the right to modify, suspend, or permanently discontinue the Tool at any time without prior notice. We recommend exporting regular JSON backups of your assessment data using the Export / Import function.

8. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Belgium. Any dispute arising from or in connection with these Terms or the use of the Tool that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the French-speaking courts of Brussels (Tribunal de première instance francophone de Bruxelles), unless mandatory consumer protection law designates another competent court.

9. Pro plan subscription

The Tool offers an optional paid subscription (“Pro plan”) that provides cloud synchronisation, unlimited organisations, sector benchmarks, history restore, and progress reports. By subscribing to the Pro plan:

10. Changes to these Terms

We may update these Terms at any time. The date below indicates the last revision. Continued use of the Tool after an update constitutes acceptance of the revised Terms.
